Agreement to Terms

By downloading, installing, or using RadTracker (“the App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App.

Description of Service

RadTracker is a personal radiation exposure tracking application that allows users to log and track radiation exposure from medical procedures, occupational sources, travel, and environmental sources; view estimated cumulative radiation doses; generate reports and visualizations; and export personal data.

Not Medical Advice

RADTRACKER IS NOT A MEDICAL DEVICE AND DOES NOT PROVIDE MEDICAL ADVICE. The App is intended for personal informational and educational purposes only. The information provided by the App is NOT a substitute for professional medical advice, diagnosis, or treatment; should NOT be used to make medical decisions; does NOT replace consultation with qualified healthcare professionals; and does NOT replace official dosimetry or radiation safety assessments. Always consult with qualified healthcare professionals, medical physicists, or radiation safety officers for medical advice and official radiation dose measurements.

Dose Estimates Are Approximate

Radiation dose values displayed in the App are estimates based on published literature from organizations including ACR, RSNA, ICRP, and EANM. Actual radiation doses may vary significantly based on specific equipment used, imaging protocols and techniques, patient size and anatomy, operator technique, facility practices, and geographic location. Do not rely on these estimates for medical, legal, occupational, or regulatory purposes.

No FDA Approval

RadTracker is NOT approved, cleared, or registered with the U.S. Food and Drug Administration (FDA) or any other regulatory body as a medical device.

Not HIPAA Covered

RadTracker is not a “covered entity” under the Health Insurance Portability and Accountability Act (HIPAA). The App is a personal wellness tool, not a healthcare provider system.

User Responsibilities

By using the App, you agree that:

1. Accuracy of Information: You are responsible for the accuracy of data you enter into the App.

2. Personal Use: You will use the App for personal, non-commercial purposes unless otherwise agreed.

3. No Medical Reliance: You will not rely on the App for medical decisions and will consult healthcare professionals for medical advice.

4. Data Security: You are responsible for maintaining the security of your account credentials and device.

5. Export Responsibility: When you export or email data from the App, you accept responsibility for that data’s security and distribution.

6. Age Requirement: You are at least 18 years old, or you have parental/guardian consent to use the App.

7. Lawful Use: You will use the App in compliance with all applicable laws and regulations.

Account Terms

Account Creation

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your password. You are responsible for all activities under your account. You must notify us immediately of any unauthorized use.

Account Termination

You may delete your account at any time through the App settings. We may suspend or terminate accounts that violate these Terms. Upon termination, your data stored locally on your device remains under your control.

Intellectual Property

Our Property

The App, including its design, features, content, and code, is owned by RadTracker and protected by intellectual property laws. You may not copy, modify, or distribute the App; reverse engineer or decompile the App; use the App’s branding without permission; or create derivative works based on the App.

Your Data

You retain ownership of the personal data you enter into the App. By using the App, you grant us a limited license to process your data solely to provide the App’s functionality.

Subscription and Payment Terms

Free Version

The free version of RadTracker provides basic radiation tracking functionality with no payment required.

Pro Version

The Pro version offers additional features for a subscription fee. By subscribing, you authorize recurring charges according to your selected plan. Subscription fees are non-refundable except as required by law. You may cancel your subscription at any time; access continues until the end of the billing period. Prices may change with notice; continued use constitutes acceptance.

Data Export and Sharing

Email and Export Features

When you use features to email or export your data, you acknowledge that email is not a secure transmission method, you accept responsibility for data once it leaves the App, you will not send data to unintended recipients, and RadTracker is not liable for data breaches occurring after you export data.

User-Initiated Sharing

All data sharing from the App is user-initiated. We do not automatically share your data with any third parties.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

1. No Warranty: The App is provided “AS IS” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

2. No Liability for Damages: RadTracker and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, personal injury or health outcomes, medical decisions made based on App information, errors in dose estimates, unauthorized access to your data, or any damages exceeding the amount you paid for the App.

3. Medical Outcomes: We are not liable for any health outcomes, medical decisions, or consequences arising from use of the App or reliance on its information.

4. Data Accuracy: We do not guarantee the accuracy, completeness, or reliability of dose estimates or other information in the App.

Indemnification

You agree to indemnify, defend, and hold harmless RadTracker, its developers, officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the App, your violation of these Terms, your violation of any third-party rights, or data you export or share from the App.

Dispute Resolution

Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.

Informal Resolution

Before filing any legal claim, you agree to contact us at support@radtracker.net and attempt to resolve the dispute informally for at least 30 days.

Arbitration

Any disputes not resolved informally shall be resolved through binding arbitration in accordance with the American Arbitration Association rules, except that you may bring claims in small claims court if eligible.

Class Action Waiver

You agree to resolve disputes individually and waive any right to participate in class action lawsuits or class-wide arbitration.

Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting updated Terms in the App, updating the “Last Updated” date, and providing in-App notification for significant changes. Continued use of the App after changes constitutes acceptance of the modified Terms.

Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and RadTracker regarding use of the App.
